Increasing Attention on Employment Misclassification.
Although employment misclassification is not a new issue, it has become an increasingly talked about subject, as the number of high profile cases continue to make their way into the spotlight. Traditionally accepted practices are not given any additional protection against the application of the misclassification laws. Expensive, high-profile litigation suits appear to be defended simply to reduce the settlement award rather than because the misclassification is legally defensible. These costs and risks exposes large businesses and small businesses indiscriminately as laws catch up to marketplace conditions and the public awareness continues to expand.
